Acceptance of Terms
By accessing or using the Sesend platform ("Service") at sesend.io, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, do not use the Service.
Description of Service
Sesend provides a cloud-based email delivery API that enables developers and businesses to send transactional and marketing emails via Amazon Web Services Simple Email Service (SES). The Service includes:
- A REST API for sending emails programmatically.
- A web dashboard for managing sending domains, API keys, and email logs.
- Delivery tracking including bounce, complaint, and open event notifications.
- Webhook delivery of email events to user-configured endpoints.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
Account Registration
To use the Service, you must:
- Provide accurate, current, and complete registration information.
- Maintain the security of your password and API keys. You are responsible for all activity under your account.
- Notify us immediately at security@sesend.io of any unauthorised access.
- Be at least 16 years of age.
You may not share your account with others or create accounts by automated means. We reserve the right to terminate accounts that violate these requirements.
Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk email (spam), phishing, or fraudulent messages.
- Send emails to recipients who have not consented to receive them, in violation of CAN-SPAM, GDPR, CASL, or other applicable anti-spam laws.
- Transmit malware, viruses, or any malicious code.
- Harass, threaten, or harm any individual or group.
- Impersonate any person, organisation, or brand you are not authorised to represent.
- Violate any applicable local, national, or international law or regulation.
- Attempt to circumvent rate limits, quotas, or access controls.
- Resell or sublicense the Service without prior written consent.
We monitor for abuse and will suspend accounts that violate this policy without prior notice. You are solely responsible for the content of emails sent through your account and for maintaining a clean, permission-based recipient list. You must honour all unsubscribe requests promptly.
To protect our shared sending infrastructure and all users, we automatically suppress recipient addresses that result in hard bounces or spam complaints. Accounts with bounce rates above 5% or complaint rates above 0.1% may be suspended.
Payment & Billing
Paid plans are billed monthly in advance. All prices are in USD and exclusive of applicable taxes. Billing is processed by Stripe. By providing a payment method, you authorise us to charge your payment method for recurring subscription fees and any overage charges.
- Overage — if you exceed your plan's monthly email limit, additional emails are billed at $0.80 per 1,000 emails and added to your next invoice automatically.
- Upgrades — take effect immediately; you are billed a prorated amount for the remainder of the current billing period.
- Downgrades & cancellations — take effect at the end of the current billing period. No refunds are issued for partial months.
- Failed payments — if a payment fails, we will retry up to three times over seven days. If payment cannot be collected, your account will be downgraded to the Free plan.
Email delivery logs are retained based on your plan: Free (1 day), Starter (3 days), Growth (7 days), Business (30 days). Logs are permanently deleted after the retention period and cannot be recovered. Upgrading your plan extends retention for future emails.
Prices may change with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Intellectual Property
Sesend and its licensors own all rights, title, and interest in and to the Service, including all software, APIs, documentation, and trademarks. Nothing in these Terms transfers any such rights to you. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service solely as permitted by these Terms.
You retain all rights to the content of emails you send through the Service. By using the Service, you grant us a limited licence to process, store, and transmit that content solely for the purpose of delivering your emails and providing the Service.
Confidentiality
Each party may have access to confidential information of the other. Both parties agree to keep such information confidential, use it only to fulfil obligations under these Terms, and not disclose it to third parties without prior written consent, except as required by law.
Your API keys are confidential credentials. Do not embed them in public repositories or client-side code. We will never ask for your API key via email or support chat.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that the Service will be error-free, that emails will be delivered within a specific time, or that delivery rates will meet any particular threshold. Email delivery is subject to factors outside our control including recipient server policies and ISP filtering.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SESEND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM OR (B) USD $100.
Indemnification
You agree to indemnify, defend, and hold harmless Sesend and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) the content of emails sent through your account.
Termination
You may terminate your account at any time from the dashboard under Settings → Danger Zone. Upon termination, your right to use the Service ceases immediately.
We may suspend or terminate your account immediately if: (a) you violate these Terms or our Acceptable Use Policy; (b) your account poses a risk to our infrastructure or other users; (c) required by law; or (d) you fail to pay amounts owed.
Upon termination, we will delete your data in accordance with our Privacy Policy. Provisions that by their nature should survive termination (including payment obligations, intellectual property, limitation of liability, and indemnification) will remain in effect.
Governing Law
These Terms are governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will send notice to the email associated with your account at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
